Welcome to AI Headshot Generator. By downloading, installing, or using the app, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.
1. Description of Service
AI Headshot Generator is an iOS mobile application that uses artificial intelligence to generate professional headshot images from selfie photos you upload. You choose a style (Corporate, LinkedIn, Creative, or Casual), and the service produces a set of AI-generated headshots. The service is provided on a one-time purchase (credit pack) basis — there is no subscription.
2. Eligibility
You must be at least 13 years old to use the app. By using the app, you confirm that you meet this requirement. If you are using the app on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
3. Account and Sign-In
You may sign in using Apple Sign In or other methods we support. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. We may suspend or terminate your account if you violate these Terms or for other reasons at our discretion.
4. Your Content and Consent
You retain ownership of the photos you upload. By uploading photos and agreeing to the in-app consent prompt, you grant us a limited, non-exclusive license to transmit your photos to our third-party AI processing partner (Astria AI) solely for the purpose of generating your headshots. You confirm that:
- You are uploading photos of yourself, or you have explicit permission from the person depicted.
- You will not upload photos that are illegal, infringing on others' rights, or otherwise prohibited.
- You have read and understood how your photos are processed, as described in our Privacy Policy.
We may suspend or terminate access if we believe content or conduct violates these Terms or the law.
5. AI-Generated Output
Headshots generated by the app are created by AI systems. Results may vary in quality and likeness. We do not guarantee that results will meet any particular standard or be suitable for a specific use. You are responsible for how you use the generated images. AI-generated images may not be used for deceptive, harmful, or illegal purposes.
6. Purchases and Credits
In-app purchases (credit packs) are processed by Apple and charged to your Apple ID. Credits are non-transferable and valid only within the app. We use RevenueCat to manage purchase entitlements. Refund requests are subject to Apple's standard refund policy. If a headshot generation job fails and cannot be completed, we will refund the credit used.
7. Third-Party Services
The app relies on third-party services including: Astria AI (AI model training and image generation), Google Firebase (authentication, database, backend functions, push notifications), RevenueCat (in-app purchases), Apple (sign-in and payments), and Expo (push notifications). Your use of the app is also subject to the applicable terms and privacy policies of these providers. We are not responsible for their services, policies, or availability.
8. Intellectual Property
The app, its design, branding, and (except for your uploaded photos and the headshots generated for you) underlying technology are owned by us or our licensors. You may not copy, modify, reverse-engineer, or redistribute the app or its components except as permitted by applicable law. The AI-generated headshots produced for you may be used for personal and professional purposes.
9. Disclaimers
THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION. USE OF THE SERVICE IS AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR AFFILIATES, OFFICERS, AND SUPPLIERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the app, your uploaded content, or your violation of these Terms or any applicable law.
12. Changes to Terms or Service
We may modify these Terms or the service at any time. We will post updated Terms on this page and update the "Last updated" date. Continued use of the app after changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using the app.
13. Termination
We may suspend or terminate your access to the app at any time, with or without cause. You may stop using the app at any time. Upon termination, your right to use the app ceases. Provisions that by their nature should survive termination (disclaimers, limitation of liability, indemnification) will continue to apply.
14. General
These Terms constitute the entire agreement between you and us regarding the app. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not waive that right. These Terms are governed by applicable law without regard to conflict of law principles.
