Welcome to AI Headshot Generator. By downloading, installing, or using the app, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

1. Description of Service

AI Headshot Generator is a mobile application that uses artificial intelligence to generate professional headshot images from photos you upload. You choose a style (e.g. Corporate, LinkedIn, Creative, Casual), and the service produces a set of AI-generated headshots. The service is provided on a one-time purchase (credit pack) basis; there is no subscription.

2. Eligibility

You must be at least 13 years old to use the app. By using the app, you represent that you meet this requirement and have the authority to agree to these Terms. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization.

3. Account and Sign-In

You may sign in using Apple or other methods we support. You are responsible for keeping your account secure and for all activity under your account. We may suspend or terminate your account if you violate these Terms or for other reasons we deem necessary.

4. Your Content and Conduct

You retain ownership of the photos you upload. By uploading photos, you grant us a limited license to use, process, and transmit them only as necessary to provide the service (including sending them to our backend and to third-party AI providers). You must only upload photos of yourself or of people who have given you permission. You may not upload content that is illegal, infringing, or that violates others' rights. We may remove content or suspend access if we believe it violates these Terms or the law.

5. AI-Generated Output

Headshots generated by the app are created by AI systems. We do not guarantee that results will meet any particular standard or be suitable for a specific use. You are responsible for how you use the generated images. Refund policies for purchases are governed by Apple's rules and our in-app policies (e.g. auto-refund if generation fails, as described in the app).

6. Purchases and Credits

In-app purchases (credit packs) are processed by Apple. Payment is charged to your Apple ID. Credits are non-transferable and used only within the app. We use RevenueCat to manage entitlements. Any refund requests for purchases are subject to Apple's refund policy.

7. Third-Party Services

The app relies on third-party services, including but not limited to: Google Firebase (auth, database, cloud functions, storage, push notifications), Astria (AI image generation), RevenueCat (purchases), Apple (sign-in and payments), and Expo (push notifications). Your use of the app is also subject to the applicable terms and privacy policies of these providers. We are not responsible for their services or policies.

8. Intellectual Property

The app, its design, branding, and (except for your content and generated output you receive) technology are owned by us or our licensors. You may not copy, modify, reverse-engineer, or redistribute the app or its components except as permitted by these Terms or applicable law.

9. Disclaimers

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION. USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR AFFILIATES, OFFICERS, AND SUPPLIERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM PERMITTED BY LAW.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the app, your content, or your violation of these Terms or any law.

12. Changes to Terms or Service

We may modify these Terms or the service at any time. We will post updated Terms on this page and update the "Last updated" date. Material changes may be communicated in the app. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the app.

13. Termination

We may suspend or terminate your access to the app at any time, with or without cause. You may stop using the app at any time. Upon termination, your right to use the app ceases; provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive.

14. General

These Terms constitute the entire agreement between you and us regarding the app. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
